Federal Judge Demands charges be filed against Andrew McCabe

The Justice Department has come under increasing pressure in its investigation of the former deputy F.B.I. director Andrew McCabe, as a federal judge threatened to release internal department records unless prosecutors decide whether to move forward with or abandon the politically charged case.

During a Monday hearing in a lawsuit from Citizens for Responsibility and Ethics in Washington (CREW) over internal FBI records related to McCabe’s termination, Judge Reggie B. Walton said if the DOJ does not make up its mind by Nov. 15, he will order the documents to be released.

“It’s been a long time and this is just dragging too long,” Walton said, according to The Washington Post, which obtained a transcript of the hearing. “And those who have to make these hard decisions need to do it. And if they don’t, I’m going to start ordering the release of information.”

Walton told the DOJ prosecutors, “You all have got to cut and make your decision. It’s not a hard decision, and I think it needs to be made.”

The U.S. Justice Department has been investigating McCabe, the FBI’s former No. 2 official, for more than 1-1/2 years over allegations he misled internal investigators about his decision to share internal communications with a reporter at the height of the 2016 presidential election.

Prosecutors and senior officials within the Justice Department, including Deputy Attorney General Jeffrey Rosen, have recommended moving forward with criminal charges, according to sources familiar with the investigation.

McCabe was fired in March 2018, just hours before he was due to retire, after the department’s internal watchdog issued a report saying he misled investigators who were trying to determine whether he improperly shared information with a news reporter during the 2016 presidential election.
